Who this is between
This agreement is between Dallas Dwight, operating Cuekeeping as a sole proprietor in South Carolina, and the invited tester who accepts it. You must be at least 18 and able to enter a binding agreement.
Purpose and access
The founding beta is a free, limited test of unfinished Sessionhand software for Ableton users. Cuekeeping will not charge you to participate. An invitation is personal, revocable and non-transferable. It gives you a temporary license to install and use the beta only for evaluation and feedback. It does not transfer ownership or promise continued access, support, updates or a commercial release.
Supported setup
The first beta is intended for Apple silicon Macs running Ableton Live 12 with Max for Live and a local Codex or Claude Code account. Other systems are unsupported unless an invitation says otherwise. You provide and pay for any third-party hardware, software and accounts you use.
Required safety steps
Use the beta only on a duplicate of an Ableton project. Keep a separate backup that the beta cannot overwrite. Do not use the beta on your only copy, during a live performance, or in a deadline-critical session. Review every proposed change before approving it and confirm the Set after a change.
Stop using the beta and contact Cuekeeping if you see unexpected file changes, repeated commands, a failed backup, missing tracks, routing changes you did not approve or any behavior that could put a project at risk.
Your music and data
You keep ownership of your projects, audio and other content. The beta is intended to run locally and will not intentionally upload your audio to Cuekeeping. Your chosen coding agent may process session metadata under that provider’s terms. Cuekeeping does not need your AI account password or API key.
Do not send confidential client material, unreleased music or another person’s data to Cuekeeping for support unless you have permission. If a future build adds telemetry or a support upload, it will be disclosed before collection.
Feedback
You are not required to assign ownership of your music or ideas. If you send product feedback, you give Cuekeeping permission to use it without payment to improve, test and market the product. Cuekeeping will not publicly identify you or use your music in marketing without separate permission.
What you cannot do
Do not share the beta build or invitation, resell access, publish private download links, remove ownership notices, bypass safety controls, use the beta to harm another system or claim Cuekeeping created or endorsed your music. Restrictions apply only to the extent allowed by law.
Pre-release risk
The beta is unfinished. It may contain errors, stop working, change without notice or produce incomplete results. You are responsible for deciding whether to use a suggestion and for checking your own files, routing, devices, exports and backups.
Warranty and liability
The beta is provided “as is” without warranties to the fullest extent allowed by law. Cuekeeping does not promise that it will be uninterrupted, error-free or safe for every Set. Cuekeeping will not be liable for indirect, incidental, special, consequential or lost-profit damages. Total liability under this agreement will not exceed $100. Nothing here limits a right or liability that cannot legally be limited.
Ending participation
You can stop at any time and uninstall the beta. Cuekeeping can suspend or end access for safety, misuse, inactivity or changes to the program. When access ends, stop using and delete the beta build. Sections about ownership, feedback, risk and liability continue to apply.
Law, changes and contact
South Carolina law governs this agreement without regard to conflict-of-law rules. If a beta update materially changes this agreement, Cuekeeping will ask you to accept the new version before continuing. Questions and incident reports can go to support@cuekeeping.com.
